Litigation
McManimon & Scotland, L.L.C. has the capacity to handle a wide range of complicated and challenging litigation matters. We have been engaged in various types of civil litigation in state and federal courts, both at the trial and appellate levels, as well as before state administrative agencies. Our areas of concentration include employment, public utilities, public contract, municipal/ governmental, environmental, banking, corporate, commercial, business, tax, insurance, as well as arbitration, mediation and alternate dispute resolution proceedings.
An important part of the firm's commercial litigation practice is advising clients how to defend and protect their interests in situations involving financial workouts or bankruptcy. The firm provides complete litigation services to creditors including pre-bankruptcy planning and workout negotiations to reduce exposure, and vigorous advocacy on behalf of individual creditors, and informal creditor groups in active bankruptcy cases. Advice to creditors regarding appropriate reorganization strategies and procedures is an integral part of the firm's litigation practice. The firm represents a wide cross-section of creditors, but devotes substantial energy to banks, other financial institutions, and commercial lenders. We also represent landlords in the bankruptcy of their tenants on questions relating to assumption or rejection of executory leases.
